In 2003, he was arrested in Panama City, Florida, facing charges of soliciting minors, racketeering, child abuse, filming minors in a sex act, and possession and intent to distribute drugs. Separately, he served nearly a year in prison in Reno, Nevada, on tax evasion charges. He received a similar prison sentence for the Florida case but was released for time served in Nevada. In 2009, he pleaded guilty to tax evasion charges and bribery, paying $250,000 in restitution to the IRS.

The conflict escalated when Francis repeated his allegations on national television, leading Wynn to sue him for slander and defamation.
